Booking Conditions

NJILA Tours Terms & Conditions

OUR AGREEMENT: All tour bookings are made with NJILA Tours (hereby referred to in this document as “the Operator”). By booking a Tour with the Operator you are deemed to have agreed to these terms and conditions, which constitutes the entire agreement between you and the Operator and your booking will be accepted by the Operator on this basis. The services to be provided are those referred to in your booking confirmation. This is valid from the time of your booking through the final day of your Tour..

 

PARTICIPATION REQUIREMENTS: All participants on our group Tours must be over the age of 21 at the time of departure. There are no age limits on our private Tours. Please contact the Operator if you have questions or concerns regarding the health or physical demands of a specific Tour. All Participants are required to have a passport that is valid for at least 6 months after the final date of your Tour. Participants are responsible for acquiring any necessary Visas or Electronic Travel Authorizations prior to departure. 

All Participants must have a valid passport and have obtained all of the appropriate visas, permits, and certificates for the countries which you will visit during your Tour. Your passport must be valid for 6 months beyond the duration of the Tour. It is your responsibility to ensure that you are in possession of the correct visas, permits, and certificates for your Tour; please refer to the Tour Details for more information. We are not responsible if you are refused entry to a country because you lack the correct passport, visa, or other travel documentation. Due to TSA Secure Flight requirements, you must enter all traveller names on your reservation exactly as they appear on each traveler's passport, including titles such as Jr. or Sr. and any multiple first, middle or last names. If accurate information is not provided, airlines may charge penalties to make corrections or even deny boarding, and you may not be permitted to enter some countries. Any changes in names or passport information should be reported to the Operator immediately via email or phone. Note that any name changes or changes in passport information after you complete your booking may result in additional fees.

YOUR PERSONAL INFORMATION: In order for the Operator to confirm your participation, you must provide all requested information at least 30 days prior to departure. Necessary details vary by Tour; they include but are not limited to full name, address, date of birth, phone number, email, nationality, proof of travel insurance, copy of passport, flight confirmations, and any medical conditions that may affect your ability to complete your Tour. Some Tours may require you to complete a Self-Assessment form. Failure to provide the requested details may result in a non-refundable cancellation of your Tour. The Operator reserves the right to store your personal details for a period of up to 5 years after your Tour. All personal identifiable information will be kept confidential. 

REFUND & CANCELLATION POLICY: To cancel your Tour booking you must inform the Operator in writing via email or via phone. If you request a refund, your refund will be returned in accordance with the cancellation policy listed below less any applicable bank charges and card payment fees. 

Cancel with no fee within 24 hours of booking. 

Cancel after 24 hours after booking – you will be charged a $300 USD cancellation fee.

Cancel with less than 90 days until departure – 50% of the cost of the Tour will be retained by the Operator.

Cancel with less than 45 days until departure – 100% of the cost of the Tour will be retained by the Operator.

The Operator does not offer payment plans. If you checked out using a third-party layaway service (i.e., Klarna, Afterpay, etc.) you will be subject to their terms and conditions in addition to the Operator’s. 

If the Operator cancels your tour due to insufficient enrolment, the Operator will endeavour to find an alternative tour for you, either the same tour on a different date or another tour of your choice. If this is not possible, your Tour will be refunded in full and will constitute full settlement. We will not be responsible for any personal expenses incurred prior to departure, including but not limited to visas, vaccinations, or international airfare. Notice of cancellation due to insufficient enrolment in any program will be given no later than 60 days prior to Tour start date.

We highly recommend you purchase a comprehensive travel insurance policy that includes Tour cancellation coverage within 3 days after booking that includes a “Cancel for Any Reason” option to cover your non-refundable Tour. Tour cancellation insurance is the only means of receiving reimbursement for flights and other non-refundable expenses should you cancel your Tour for any reason, whether voluntarily or as a result of the Operator  actions.

FINAL PAYMENT DATE: Tours must be paid in full 30 days before the Tour. If full payment is not received by that date, the Operator  reserves the right to cancel the Tour.

TRANSFERRING TO ANOTHER PERSON: You can transfer your Tour to another traveller anytime before 45 days prior to departure by notifying the Operator via email or phone provided that person meets all Participation Requirements. 

TRANSFERRING TO A PRIVATE Tour: You may cancel a group Tour and turn it into a Tour credit that can be applied to a Private Tour. The Tour format can be changed no later than 6 months prior to the departure date of the Tour you were originally registered for. 

BOOKING PRICING & AVAILABILITY: Tour pricing fluctuates and at any time before a confirmed reservation, the tour price may be increased or decreased without warning. Once your booking is confirmed by the Operator, the price is locked in and will not increase.

ARRIVAL AND TRANSFER INFORMATION: We advise you not to book air arrangements until the tour has been confirmed. Notification of a guaranteed departure will be made no later than 110 days prior to scheduled departure. You will be responsible for any costs incurred should your flight arrangements be delayed, or should we have to change the tour start/end points or dates after the tour has been guaranteed.

It is your responsibility to provide the Operator with your air travel schedule prior to your departure so we can confirm your arrival and arrange transportation.

ROOMMATE POLICY: Accommodations are booked as double occupancy room as standard. If you book double occupancy for your Tour and you do not have a roommate, as a courtesy, we will attempt to pair you with another client of the same gender who also needs a roommate after you are paid in full. However, if by 45 days prior to departure you are not assigned a roommate, you will be required to pay the single occupancy supplement. Payment of the single occupancy supplement is due no later than 30 days prior to departure.

SPECIAL REQUESTS: Hotel check-in on the first day of the tour will be in accordance with the hotel's usual check-in times. The Operator will request early check-in for early arrivals, however this cannot be guaranteed. We will attempt to accommodate any special requests by notifying our suppliers in writing; however, we cannot guarantee that such requests—room locations, adjoining rooms, seating requirements and meal requirements for hotels, etc—will be adhered to by our suppliers. Any dietary restrictions communicated to the Operator are noted with respect to included meals on tour; however, we cannot guarantee that dietary needs or restrictions can be accommodated, nor will we be liable for any failure to accommodate or fulfill such requests.

ITINERARY CHANGES: Itineraries and hotel selections are subject to modification and change due to availability or vendor partner changes at any time. In the unlikely event that there are major changes to the itinerary, clients are notified as soon as possible via email and phone and a substitution of equivalent value will be offered.

REQUIRED TRAVEL MEDICAL INSURANCE: All Participants are required to purchase an International Travel and Health Insurance policy that includes (1) Emergency Medical Coverage, (2) Emergency Medical Evacuation, and (3) Repatriation of your remains should you perish. You are required to provide a Proof of policy document from your insurance provider to the Operator no later than 45 days prior to departure. Your US Health insurance will most likely not satisfy these requirements.

HEALTH & WELLNESS POLICY: All Tours require that you can walk at least 5 miles each day on your own. You should consult your physician to confirm your fitness level for travel and participation in planned activities. The Operator does not provide medical advice. Please ensure you review the itineraries in detail and notify the Operator if you have issues with walking so proper accommodations can be made.

PHOTO/VIDEO RELEASE: Photography and video of the Tour activity are taken throughout the experience and shared with clients post-Tour. By participating on this Tour or at this event you are giving the Operator; its representatives and employees the right to use photographs, video, and testimony given by you during the  “Tour”, any “Lifestyle Experience”, or “Lifestyle Event”. The Operator will not disclose your name online or in printed media without acquiring additional expressed written consent.

LIMITATION OF LIABILITY: We accept no responsibility for accidents, damage, baggage losses, delays, and/or accidental expenses due to weather, strikes, acts of God, acts of governments or authorities, wars, terrorism, criminal acts committed by third parties, hostilities, civil disturbances, riots, strikes, sickness, quarantine, defects of vehicles or breakdown in the equipment, or to the fault or default of any company used for carrying out these packages. Regarding any and all services and accommodations furnished, we expressly disclaim all responsibility or liability over any matter whatsoever for loss, damage, injury, or expense to property or person due to any cause whatsoever occurring during the duration of the Tour or otherwise. All such losses or expenses will be borne by the passengers. You understand that if any Tour has to be delayed because of weather, road conditions, flight delays, cancellation of common carriers, sickness or other contingencies for which we cannot reasonably make provision, the cost of your delay and/or replacement is not included in the Tour fees. All payments must be paid locally. In consideration of, and in part payment of, the right to participate in the Tour, you will fully assume all risk of the above hazards and hereby release and discharge the Operator and our agents from all actions, claims or demands resulting from your willing participation in the Tour. You are aware that this is a release of liability and a contract between you and the Operator and that you accept it of your own free will. This agreement shall serve as a release for you, your heirs, administrators, executors and for all members of your family

TOUR CANCELLATION FOR REASONS OUTSIDE OUR CONTROL: In the rare event that it becomes necessary to cancel the Tour for reasons beyond our control, such as terrorism, strikes, acts of governments, weather, etc. we will reschedule the Tour. Tour delays due to COVID-19 fall under this clause. If you are unable to attend the new Tour dates you will receive a Tour credit valid for 12 months from the date your Tour is rescheduled to apply to a future Tour.

AUTHORITY ON TOUR: Our group Tours are run by a designated team member referred to as the Tour Leader. The decision of the Tour Leader is final on all matters likely to affect the safety or well-being of any participant or team member participating in the Tour. If you fail to comply with a decision made by a Tour Leader or interfere with the well-being or mobility of your Tour participants, the Operator reserves the right to remove you from the Tour immediately, without a refund. The operator may also elect not to carry you on any future Tours booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.

EXPIRATION

This Contract is valid from the date of booking through the final date of your Tour.
